U.S. Lawyer Filing Foreign Patents
The protection of patent rights in a global market has its challenges. It used to be that your invention only needed to be protected in your country. Now, however, with the proliferation of the Internet, a breakthrough software product is immediately accessible all over the world, with the potential of being copied.
Seeking a patent enforceable in foreign countries requires expertise in international patent law, specific expertise in computer hardware and software patents, and detailed knowledge of the invention being patented.
Do you need a U.S. lawyer experienced in international patent protection? Contact us at Robert Plotkin, P.C., today. Call toll-free: 877.451.5689 or 978.318.9914.
Boston, Massachusetts, International Patent Protection Attorney
If you want to stop someone from using your invention in a foreign county, you must usually obtain a patent specific to that country by filing a foreign patent application — a United States patent will only protect you against infringement in the U.S.
A U.S. lawyer filing foreign patents simultaneously in multiple countries at once is effective but not usually ideal. It is also a potentially risky investment when you might not yet know the commercial value of your invention at the time you file.
At the outset, your best option in most situations is to file a patent application in one country to preserve your patent rights in most other countries for up to one year. In this way, you have the opportunity to gauge the earning potential of your invention and gather the necessary funds to seek additional patents.
Before that year has expired, you have several options to choose from in deciding how to best protect your invention in other countries. These options include:
- Filing an application in other countries
- Filing an application in a regional patent office
- Filing a Patent Cooperation Treaty (PCT) application
Robert Plotkin provides his clients strategic and helpful advice on the benefits and disadvantages of these options, in addition to providing advice on budgeting for the costs of protecting patent rights internationally by filing foreign patents. He can also assist in filing patent applications internationally through an exclusive international network of patent attorneys.
